Terms & Conditions A rental agreement is required to be signed by the lead guest. This
will be sent to the guest for signature. Payments: A deposit of $350 is required to secure
your booking which is Non Refundable.The balance of your total rental cost is due 8 weeks
prior to arrival. Payment may be made by credit card or check. We do require that you leave
a credit card on file with us in the event of property damage this is standard procedure in
case any charges need to be applied due to damage to the property.You will be notified
before any charges are applied Utilities: All utilities, electricity, water, waste disposal,
telephone, internet, cable, management fees, maintenance contracts, community charges, HOA
fees, etc. are included in the rental fees and the tenant shall not be required to pay
additional monies on account. EXCEPTION: Long distance phone charges, as well as excessive
use of utilities resulting in a cost rising by 100% or more. This is to prevent wasteful
usage in the home example: leaving a hose running for an extended period of time. Damages:
Every effort is made to inspect for damages after the departure of each renter, however some
things may go unnoticed. It is therefore requested that each new renter do their own
reasonable inspection of the home and its contents upon arrival. If anything appears to be
broken, damaged, or missing, please email or call the management company, Prestige Florida
Villas to let them know. In doing so, you will avoid being assumed responsible for something
that may have already existed when you arrived. Your efforts in this regard are greatly
appreciated. Additionally, should you incur any accidental damage during your stay, please
inform the management company of this damage the day it happens. Guests must not move
furniture or remove furniture from the home. The owner or property manager has the authority
to inspect the property during your stay.
Cancellations: No one wants to cancel their well-deserved vacation, but sometimes we need to
cancel even the best made plans. The following outlines our cancellation policies: 1. All
cancellations are Non Refundable 2. If a reservation needs to be rescheduled or dates
modified, within reason, then any deposit already paid will transfer with the booking dates,
provided the dates are available. However, this will be at the discretion of the management
company and determined on an individual basis. Because this is a private home with a private
lease, there can be no credit given in case of early departure, and there will be no
sub-letting or assignment by tenant without prior written consent. Check in time is 4:00 pm
and check out time is 10:00 am. Many bookings are back to back and our team of cleaners
requires this amount of time between renters to do a thorough job. Early check in or late
check out may be possible if it is not a turn over day, but this requires prior approval at
an additional fee. Please contact Prestige Florida Villas as each situation is individual.
Occupancy: Only those listed on the attached Guest List are authorized to use the property.
Any changes to the persons booked to occupy the home must be notified for insurance reasons.
Please note that this home will only accommodate up to the MAXIMUM occupancy this limit
should not be exceeded. Pets: This is a pet free home.
Smoking: This is a non-smoking home, and smoking is only permitted outside. If you choose to
smoke in the yard or on the patio, please be respectful and use a suitable method of waste
disposal. Pool: Because there are no lifeguards or other attendants, tenants are solely
responsible for the safety of themselves, family members and guests using the pool, and in
so using or permitting to be used, specifically waive any and all liability claims. No
tenant shall permit any juvenile member of his family or guest to play in or around the pool
without providing an attendant who is able to swim and can protect such juvenile in case of
difficulty in the water. The tenant is expected to conduct himself as a guest with
reasonable decorum; violent/rough games and exercise are not permitted. Spa, Deck, and
Patio: The tenant hereby acknowledges that the property they have reserved includes a
swimming pool, spa, and patio area. The undersigned is fully aware that the surrounding
areas can be dangerous and slippery when wet, and that injury is likely to occur to anyone
who is not careful. Tenants should observe and adhere to all rules and policies as posted at
the property. With full knowledge of the above facts and warnings, the undersigned accepts
and assumes all risks involved in or related to the pool, spa, and patio areas. No glassware
is permitted in the pool area. Acrylic dinnerware and tumblers are available for dining on
the patio.
Utility/Cleaning: There is a standard move-out cleaning fee added to or included in your
rental cost. If the property is left in a condition that requires more than standard
move-out cleaning, an extra fee will be incurred. All kitchens must be left clean and
orderly, no dirty dishes, ovens, or stoves. Cleaning personnel will clean out refrigerators
and empty dishwashers. All used towels and bed sheets should be washed or placed in laundry
baskets, provided in the garage by the washer and dryer. Excessive laundry will be charged
extra and billed to your credit card. Trash/Garbage: Guests are responsible during their
stay for putting trash/garbage out to the roadside on the designated days. This information
will be found in the guest handbook. On departure, all trash/garbage must be bagged and left
ready to dispose of if it is not a trash pickup day. A garbage enclosure is provided at the
side of the house. Please do not leave filled garbage bags in the house or garage. Excessive
trash/garbage will incur separate charges and will be billed to your credit card. Recycling
bins are also provided for your use during your stay. Parking: There is no indoor parking as
the garage has been converted to a games room for your enjoyment, but there is parking in
the paved driveway. No large vans or trucks, motorcycles, boat trailers, or recreational
vehicles are permitted on the premises without special approval. Personal Belongings: The
tenant shall be solely responsible for any thefts, acts of vandalism, or other damage or
loss of personal property which may occur during the course of this agreement, whether said
damage or loss be the property of the tenant or any other person invited in by the tenant,
unless such damage is specifically caused by the negligence or incompetence of the owner or
the owner’s agent. A home security system has been installed for your use, and a
personal safe is available to use during your stay.
Liabilities and Responsibilities: The owner and owner’s agent commit to keeping the
property in its normal, safe, usable and habitable condition. In the event that the property
is rendered unsafe, not usable or habitable by the local authorities and has not been caused
by the tenant’s actions, the tenant shall immediately be relieved of his obligations
under this agreement. He shall be refunded the unused portion of his rent and deposit. In
the event of equipment failure, please notify the owner or property manager for repairs or
renewals. The tenant, however, expressly waives and relinquishes any rights or claims
against the owner or manager for any damage that may result to the tenant from lack of
maintenance, repair, or defect, including owner’s or manager’s ordinary
negligence. All personal property of the tenant kept on the premises is at the risk of the
tenant. There will be no refund, or part of the rental amount, for any failure of any of the
equipment to work. The only exception is the pool heat, which would be refunded on a pro
rata base. No refund can be made for inclement weather, water temperatures that are above 82
degrees, or for days when the pool is not in use. Please do not attempt to adjust the pool
heating yourself as it is very easy to break and very expensive to fix. You will be liable
for all costs to put it right. The owners and the owner’s agents do not accept
liability for personal injury, accidents, loss, or damage to persons or personal effects
howsoever caused. In the event that the owner removes the property from the management
program, or due to other circumstances the house is not available, then every effort will be
made to find a similar property. Owner or agent should not be liable to the tenant should
similar units not become available, whereby monies paid shall be refunded. Each party agrees
to pay all costs incurred by other party in enforcing, by legal proceedings or otherwise,
the terms of this lease and reasonable attorney’s fees. Each party hereby knowingly,
voluntarily, and intentionally waives any right each party may have to a trial by jury with
respect to any litigation arising out of, under, or in connection with this lease. Join and
Several Liability: All guests and owners shall be jointly and severally liable for all terms
and conditions set forth in this agreement.
PLEASE NOTE: While we endeavor to give a high level of service to our guests, any issues or
problems regarding your vacation stay must be dealt with prior to departure. Under no
circumstances will these be addressed after your vacation stay.
